Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the services provided by GTM Stacker ("we," "our," or "us"). By accessing our website or using our services, you agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use our services.
Description of Services
GTM Stacker provides content creation and authority-building services for founders, including:
- Content strategy development
- Voice and tone research
- Daily social media content creation (primarily for X/Twitter)
- Threads and long-form content
- Engagement support (for applicable tiers)
- Strategy consultations
The specific deliverables depend on your selected service tier, as described on our website and confirmed in your service agreement.
Eligibility
To use our services, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding agreement
- Provide accurate and complete information
- Not be prohibited from using our services under applicable law
Account and Access
Your Responsibilities
You are responsible for:
- Maintaining the confidentiality of any account credentials
- All activities that occur under your account
- Providing accurate, current, and complete information
- Notifying us immediately of any unauthorized access
Our Rights
We reserve the right to:
- Suspend or terminate access for violation of these Terms
- Refuse service to anyone for any reason
- Modify or discontinue services with reasonable notice
Service Tiers and Pricing
Pricing
Current pricing is displayed on our website. Prices are subject to change with 30 days' notice to existing subscribers.
Billing
- Subscriptions are billed monthly or annually, depending on your selection
- Payment is due at the beginning of each billing period
- All fees are non-refundable except as expressly stated in these Terms
Changes to Your Subscription
- You may upgrade your tier at any time (prorated charges apply)
- You may downgrade your tier effective at the next billing period
- You may cancel your subscription at any time (see "Cancellation" below)
Cancellation and Refunds
Cancellation by You
You may cancel your subscription at any time by:
- Notifying us via email at theo.p@mail.gtmstacker.com
- Providing at least 7 days' notice before your next billing date
Upon cancellation:
- Your service continues until the end of the current billing period
- No refunds are provided for partial months
- All content created during your subscription is yours to keep
Cancellation by Us
We may cancel your subscription if:
- You breach these Terms
- Payment fails and is not resolved within 14 days
- You engage in behavior that harms our reputation or business
We will provide reasonable notice except in cases of serious breach.
Refunds
- Annual subscriptions: If you cancel within the first 30 days, you may request a prorated refund minus any content already delivered
- Monthly subscriptions: No refunds for partial periods
- Service issues: If we fail to deliver agreed-upon content for 7 or more consecutive days due to our fault, you may request a prorated credit
Content Creation and Approval
Our Process
- We research and create content based on your inputs and our strategy
- Content is delivered to you for review (typically via email)
- You review, approve, request revisions, or reject
- You publish approved content to your accounts
Your Responsibilities
You are responsible for:
- Providing accurate information about your product, company, and audience
- Reviewing delivered content in a timely manner
- Final approval of all content before publishing
- Publishing content to your own accounts (unless engagement add-on is purchased)
Revisions
- Each piece of content includes reasonable revisions
- "Reasonable" means adjustments to tone, wording, or focus—not complete rewrites
- Excessive revision requests may require discussion about fit or tier adjustment
Content You Reject
If you consistently reject content (more than 30% over a 30-day period), we will schedule a call to realign on strategy. If alignment cannot be reached, either party may terminate with 14 days' notice.
Intellectual Property
Content Ownership
- Your content: All content we create for you is yours upon delivery. You own full rights to use, modify, and distribute it.
- Your inputs: You retain ownership of all materials you provide to us (product info, brand guidelines, etc.)
- Our systems: We retain ownership of our processes, frameworks, research methodologies, and internal tools.
License to Us
You grant us a limited license to:
- Use your brand name, logo, and product information to create content
- Access your social media accounts via official delegation features (if applicable)
- Use anonymized results for internal analysis and service improvement
Case Studies and Testimonials
We may request permission to:
- Feature your results as a case study
- Use your name and testimonial in marketing
This requires your explicit written consent. You may decline without affecting your service.
Your Conduct
You agree not to:
- Provide false or misleading information
- Use our services for illegal purposes
- Request content that violates laws or third-party rights
- Request content that is defamatory, hateful, or harmful
- Attempt to reverse-engineer our processes or systems
- Resell our services without authorization
- Harass, abuse, or threaten our team members
Acceptable Use
Content we create will not include:
- False claims about your product or competitors
- Misleading statistics or fabricated testimonials
- Content that infringes third-party intellectual property
- Hate speech, discrimination, or illegal content
- Medical, legal, or financial advice (unless you are qualified and take responsibility)
If you request content that violates these standards, we will decline and offer alternatives.
Disclaimers
No Guaranteed Results
While we strive to create high-quality content that builds authority, we cannot guarantee:
- Specific follower counts or engagement rates
- Viral content or specific reach
- Revenue, leads, or business outcomes
- Algorithm performance on any platform
Results depend on many factors outside our control, including your product, market, timing, and platform changes.
Service Provided "As Is"
To the maximum extent permitted by law, our services are provided "as is" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
Cap on Liability
To the maximum extent permitted by law, our total liability to you for any claims arising from or related to these Terms or our services is limited to the amount you paid us in the 3 months preceding the claim.
Exclusion of Damages
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including:
- Lost profits or revenue
- Lost data
- Business interruption
- Reputational harm
This applies even if we were advised of the possibility of such damages.
Exceptions
These limitations do not apply to liability that cannot be excluded by law.
Indemnification
You agree to indemnify and hold harmless GTM Stacker and its team from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your breach of these Terms
- Your use of content we create (after your approval)
- Your violation of any third-party rights
- False or misleading information you provide
Confidentiality
Our Obligations
We will keep confidential:
- Your business information and strategies
- Unpublished product details
- Any information you designate as confidential
We will not share confidential information except:
- With team members who need it to deliver services
- As required by law
- With your consent
Your Obligations
You agree to keep confidential:
- Our pricing (except your own rates)
- Our internal processes and methodologies
- Any proprietary information we share with you
Dispute Resolution
Informal Resolution
Before filing any formal dispute, you agree to contact us and attempt to resolve the issue informally for at least 30 days.
Governing Law
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.
Jurisdiction

Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment
You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, or internet outages.
